Terms of service
Last updated: 8 October 2026
These terms govern access to the EduPresence website and platform provided by [Company Legal Name] Private Limited (“we”). The institution that subscribes (“Customer”) agrees to these terms together with its order form and Data Processing Agreement (“DPA”). Users invited by the Customer - staff, parents and students - use the platform under the Customer's account.
1. The service
EduPresence provides software for attendance, leave, student and staff records, transport safety, notifications and reporting, with optional edge AI software for face recognition and optional hardware supplied under a separate order. Features available depend on the plan purchased.
2. Accounts and access
- The Customer is responsible for the users it creates and the roles it assigns.
- Users must keep credentials confidential; administrators must enable two-factor authentication.
- Parents sign in with a one-time password sent to their registered mobile number.
- Edge device API keys must be stored securely and rotated if exposed.
3. Customer responsibilities
- Act as Data Fiduciary under the DPDP Act 2023: give notices, obtain verifiable parental consent before enrolling a child's face, and honour withdrawal and other rights requests.
- Offer a non-biometric attendance alternative (RFID, QR or manual) to anyone who does not consent.
- Not use the service for emotion or behaviour analytics, surveillance beyond attendance and safety, or any unlawful purpose.
- Ensure data imported into the platform is accurate and lawfully obtained.
- Use DLT-registered templates for SMS and comply with messaging platform policies.
4. AI features
Face recognition is probabilistic. The platform uses thresholds, margins, multi-frame voting and human review to minimise errors, but no system is error-free. Attendance decisions with consequences for a student must be confirmed by authorised staff; the Customer must not rely on AI output alone to penalise anyone. Performance depends on camera placement, lighting and enrollment quality.
5. Fees and payment
Fees are set out in the order form. Prices on the website are indicative only. Fees are exclusive of GST. SMS and WhatsApp credits are billed at the rates in the order form. Unpaid invoices beyond 30 days may lead to suspension after notice. Refunds are governed by the order form and our refund policy.
6. Data ownership, export and deletion
The Customer owns its data. It can export lists and reports at any time. On termination we provide an export window of 30 days, after which data is deleted from production systems and, within the backup cycle, from backups - except where retention is required by law. Face templates are deleted at termination.
7. Availability and support
We target 99.5% monthly availability for the cloud service (Enterprise SLA terms prevail where agreed). Edge devices are designed to keep working offline and sync later. Planned maintenance is announced in advance. Support channels depend on the plan.
8. Hardware
Hardware supplied by us is covered by the manufacturer's warranty and any AMC purchased. Installation assumes site readiness (power, network, mounting points) agreed in the site survey.
9. Acceptable use
You must not attempt to breach security, reverse engineer the service (except as permitted by law), use it to send spam, or upload malicious code or content you have no right to process.
10. Warranties and liability
The service is provided with reasonable skill and care. To the extent permitted by law, our aggregate liability is limited to the fees paid in the twelve months before the claim, and neither party is liable for indirect or consequential losses. Nothing limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of India. Courts at [City] have exclusive jurisdiction.
